1. Our commitment about your personal information

Australia Pacific LNG Pty Limited (ABN 68 001 646 331) (we, our or us) is a joint venture between Origin Energy Limited (Origin), ConocoPhillips Australia Pacific LNG Pty Ltd (CAPLNG), and Sinopec Australia Pacific LNG Pty Ltd (Sinopec) (collectively, the Shareholders).

We respect your privacy, and how we manage any personal information you provide to us is governed by the Privacy Act 1988 (Cth) (Privacy Act) and the Australian Privacy Principles (APPs).

This Privacy Policy explains how we manage the personal information we collect and hold about you.

In this Privacy Policy, the term ‘personal information’ has the meaning given to it in the Privacy Act:

any information or opinion about an identified individual, or an individual who is reasonably identifiable, whether the information or opinion is true or not and whether the information or opinion is recorded in a material form or not.

Personal information may include, for example, your name, current and previous addresses, date of birth, telephone number and email address. If the information we collect identifies you, or your identity can be reasonably ascertained from it, then that information is considered personal information.

Some information may also be considered ‘sensitive information’. Under the Privacy Act, sensitive information includes, but is not limited to:

  • information or an opinion about an individual’s race, ethnic origin, criminal record, political opinions, religious beliefs, trade union membership, sexual orientation or practices; and
  • health, genetic and biometric information.

In this Privacy Policy, reference to personal information includes sensitive information, unless expressly stated otherwise.

2. Our management of personal information generally

When you interact or correspond with us, you will ordinarily have to identify yourself, which will involve providing your personal information to us. It is impractical in most circumstances for you to remain anonymous and we may not be able to do business with you or answer your enquiry if we cannot identify you or collect your personal information. If practical and appropriate in the circumstances, you may not have to identify yourself when you interact with us or you may use a pseudonym.

We may appoint Shareholders (or their related bodies corporate) as operators, service providers or agents to collect and manage personal information on our behalf. Where this occurs, the relevant Shareholder group’s privacy policy will also apply to any personal information those entities collect.

When we collect your personal information for a particular purpose (primary purpose), we will not use or disclose that information for another purpose (secondary purpose) unless:

  • you consent to that use or disclosure; or
  • you would reasonably expect us to use or disclose the information for the secondary purpose, and the secondary purpose is related to the primary purpose (or, where the information is sensitive information, the secondary purpose is directly related to the primary purpose); or
  • the use or disclosure is required or authorised by law; or
  • a permitted general situation exists in relation to the use or disclosure (these situations are defined in the Privacy Act, and include, for example, where the use or disclosure is reasonably necessary in relation to a legal claim or dispute resolution process); or
  • a permitted health situation (as defined in the Privacy Act) exists in relation to the use or disclosure; or
  • we reasonably believe that the use or disclosure is reasonably necessary for one or more of the enforcement related activities, on or on behalf of, an enforcement body.

3. How do we collect personal information?

We may only collect your:

  • personal information, if the information is reasonably necessary for one or more of our functions or activities; and
  • sensitive information, if:
    • you consent and the information is reasonably necessary for one or more of our functions or activities; or
    • as otherwise permitted or required under the Privacy Act.

We will collect your personal information directly from you unless it is unreasonable or impracticable to do so. We may collect personal information directly from you in a number of ways, including through our website, by telephone, through any documents (such as contracts or public records) you provide to us, written correspondence (such as letters and emails), and in person.

We may also collect your personal information from authorised third parties (for example, your advisers or representatives) in certain circumstances, including where you would reasonably expect it or where you have consented to your personal information being shared.

We may also collect personal information about you from third parties we deal with, including:

  • our related bodies corporate;
  • our Shareholders or their related bodies corporate;
  • government and law enforcement agencies;
  • our professional advisers (for example, our consultants);
  • our contracted operators, service providers and agents; and
  • any other organisation conducting activities on our behalf.

4. What personal information do we collect?

We collect a range of personal information in connection with conducting our business primarily as a producer and supplier of natural gas. The types of personal information that we may collect about you will depend upon the nature of our relationship with you. These may include (but are not limited to) the following.

  • Community engagement and enquiries – We collect personal information from other members of the community who contact us. Where we interact with community organisations and similar stakeholders, we may also collect personal information about identified individuals or the representatives of these organisations as part of this engagement. This may include:
    • your contact and identification details such as your name, address, date of birth, telephone number and email address;
    • any correspondence between you and us; and
    • any other personal information you provide when you make an enquiry, request information, correspond with us or make a complaint, including information necessary to respond or address any community or other concerns that have been raised with us. If it is relevant to the enquiry or concern, this may include collecting sensitive information (such as health information).
  • Applicants – If you are applying for a position with us (either as an employee, secondee or a contractor), we will ask you to provide specific personal information, including, but not limited to, your name, email address, telephone number, proof of right to work documents, qualifications and career history. We may also collect sensitive information, such as information about race, ethnic origin, criminal record and health.

We may also ask you to provide other personal information in relation to an application for employment, such as your interests and the position(s) you are interested in. If we ask you to provide contact details for employment references, it is your responsibility to inform the people that you are nominating as references that you have provided their contact details to us and that we will hold their information in accordance with our Privacy Policy.

  • Employees – If you are, or become, one of our employees, we will collect employee records and personal details, referee reports and other information about you.
  • Secondees – If you are seconded from your employer to work with us, the Privacy Act will apply to any personal information that we collect, use, hold and disclose about you. The types of personal information we may collect include your contact and identification details such as your name, address, telephone number, email address, proof of right to work documents, qualifications and career history.
  • Contractors – If you are engaged by us as a contractor, the Privacy Act will apply to any personal information that we collect, use, hold and disclose about you. The types of personal information we may collect include:
    • your contact and identification details such as your name, address, date of birth, telephone number and email address;
    • your banking details and other details that we may need in order to pay you;
    • contact and identification details of any third party that you have authorised to negotiate on your behalf;
    • any correspondence between you and us; and
    • any other personal information you provide when you make an enquiry, request information, correspond with us or make a complaint.
  • Customer representatives – In our dealings with our corporate buyers, we may collect personal information relating to buyers’ individual representatives (including name, telephone number and email address).
  • Landholders – We collect and hold personal information (including sensitive information) relating to landholders, including those contemplating entering into a contractual relationship with us for land access arrangements or otherwise. This information is held by our operators. This may include:
    • your contact and identification details such as your name, address, date of birth, telephone number and email address;
    • your banking details and other details that we may need in order to pay you;
    • the name, address and contact details of any third party that you have authorised to negotiate on your behalf, including any attorneys appointed by you under a power of attorney;
    • any correspondence between you and us; and
    • any other personal information you provide when you make an enquiry, request information, correspond with us or make a complaint.

If we are unable to collect personal information in the above circumstances, we may be unable to enter into the relevant business or employment relationship or respond to enquiries, concerns or requests.

5. Why do we collect, hold, use and disclose your personal information?

We collect, hold, use and disclose your personal information for a number of purposes, including:

  • Community engagement and enquiries – to respond to your enquiry or concern;
  • Applicants – where you are applying for a position with us, to:
    • consider you for current and future employment or engagement as an employee, secondee or a contractor;
    • assist us in the selection and recruitment process;

If your application is unsuccessful, the Privacy Act will apply to any personal information that we collect, use, hold and disclose about you. We may retain this information for a reasonable period of time, for example, to enable us to contact you in relation to other employment, secondment or contracting opportunities that you may be interested in. 

  • Employees – to manage your employment relationship with us;

The handling of your personal information as an employee may be exempt from the Privacy Act if it is directly related to your current or former employment relationship with us. However, we will not disclose your personal information for any other purpose unless required or authorised by law.

  • Secondees – to:
    • arrange and manage your secondment;
    • communicate with your employer concerning your secondment and related matters;
  • Contractors – to manage and administer our engagement of you as a contractor;
  • Customer representatives – to communicate with you about our relationship with the corporate buyer you represent;
  • Landholders – where you are a landholder:
    • to decide whether or not to enter into a contractual relationship with you;
    • for the purpose of your business or other relationship with us;
    • to respond to your enquiry or concern and provide any information or documents requested by you; and

and, in all cases, to:

  • communicate with you about your business or other relationship with us;
  • process and respond to your complaint if you lodge a complaint with us;
  • update our records and keep your contact details up to date;
  • do anything which you authorise or consent to us doing; or
  • take any action we are required or authorised by law to take.

6. Disclosure of personal information 

We may disclose your personal information to other entities, including to:

  • our related bodies corporate;
  • our Shareholders or their related bodies corporate;
  • your authorised representative(s);
  • financial institutions (for payment processing);
  • any entity to which we are authorised or required by law to disclose your personal information (such as law enforcement agencies and government and regulatory authorities); and
  • our operators, service providers and agents, for example information technology suppliers, maintenance contractors, mailing services and logistics providers and our professional advisors (such as accountants, auditors and lawyers); and
  • with your consent (express or implied) – other entities.

We will take reasonable steps to ensure these entities manage your personal information in accordance with the Privacy Act. However, we do not accept responsibility for misuse of personal information by third parties. To the extent permitted by law, we exclude all liability (including in negligence) for the consequences of any unauthorised access to your personal information.

7. Disclosure of personal information to overseas recipients

We may sometimes disclose your personal information to third parties (such as service providers or Shareholder related entities) located outside Australia. Such recipients are predominantly located in the United States and China. If we do so, we will take reasonable steps to ensure your personal information is managed in accordance with the Privacy Act.

8. Security, quality and location of your information

We use a range of security mechanisms and controls to protect your personal information and will take all reasonable steps to ensure that it is stored securely. Except to the extent specified otherwise in this Privacy Policy, we will hold your personal information in an electronic system located in Australia. We do not trade personal information to or with third parties.

We will take reasonable steps to securely destroy, delete or de-identify your personal information once we no longer need it for the purpose for which we collected it, and where it is not required to be retained by or under Australian law or court/tribunal order.

We expect all our staff to comply with the Privacy Act and our Privacy Policy and will take appropriate actions to address any breaches.

9. Our website

Our website may use cookies to collect information about your use of the website (such as date and time of visit, pages viewed, and documents downloaded). We may use and disclose this information in anonymous, aggregated form, for purposes including statistical analysis and web site development, or where otherwise required or authorised by law.

Our website may contain links to other websites operated by third parties. We make no representations or warranties in relation to the privacy practices of any third party website and we are not responsible for the privacy policies or the content of any third party website.

10.Use of facial recognition security cameras 

We use closed circuit television (CCTV) surveillance with facial recognition technology at our premises at Level 3, 145 Ann Street, Brisbane. In addition to CCTV footage, where an individual’s face appears in the footage, the security system takes an image of the individual’s face. Biometric data is generated from that image and compared against a database of other images to determine whether there is a match. The secure system collects the individual’s personal information, which may include sensitive information. We use information collected by the security system to prevent, manage and verify incidents involving criminal behaviour, misconduct and other inappropriate behaviour and provide us with visual coverage during emergencies. All personal information will be collected, used, disclosed and managed in accordance with this Privacy Policy. Entry to these premises may be denied where the individual does not agree to these conditions.

11. Access and correction

We take reasonable steps to ensure that the personal information we collect and hold about you is accurate, up-to-date and complete. Please advise us promptly if there is any change to your personal information, or if you believe that any information we hold about you is inaccurate, out-of-date, incomplete, irrelevant or misleading. We will allow access to or use all reasonable efforts to correct the information unless the law permits or requires us to withhold the information or not make the correction. We will do this within a reasonable time. We may first require proof of identity. If we deny your request, we will tell you why. If we correct any personal information we hold about you, you may request that we notify a third party that we have corrected any personal information that we hold about you. We will take reasonable steps to comply with such a request.

12. Complaints and contacting us

Depending on the complaint, our complaints process is managed by us, or a Shareholder (or its related body corporate) acting as operator, service provider or agent on our behalf. If you believe that your privacy has been breached or you have a complaint in relation to our handling of your personal information, please contact:
